What is it?

The first case of corporate manslaughter under the Corporate Manslaughter Act, 2007 has just begun in the Bristol Crown Court. The accused in the case are Cotswold Geotechnical Holdings Ltd. and its director, Peter Eaton who has been charged for corporate manslaughter on the ground of gross negligence.
Eaton appeared before the Court and answered basic questions regarding his name etc. He has been granted a bail with no strings attached by Thomas Crowther QC until the next hearing. The next hearing is scheduled for 19th August when the accused will plead either guilty or not guilty.
The facts of the case are that Alexander Wright, a geologist who was working in the company, was killed at the end of last year due to the caving in of a trench when he was collecting soil samples for his work.
The Crown Prosecution Service has charged Peter Eaton under Section 37 of the Health and Safety at Work etc. Act 1974 (’HSWA’) in addition to the charge of corporate manslaughter. Under this section, in case of a workplace mishap, which takes place with the consent, negligence or connivance of a senior office holder of a company, such an office holder can be prosecuted. Make sure your organisation is aware of its health and safety obligations and has a clear understanding of its statutory duties with a well regarded NEBOSH level course; designed to help those with health and safety responsibilities to carry out their duties at work more effectively and to protect the organisations for which they work.
